1. Introduction

These Learner Terms and Conditions ("Learner Terms") govern the booking and participation in driving lessons, test-day packages and related services booked through the Drivelo Platform. They form part of the Drivelo Platform Terms of Service.

By creating a Learner account, making a Booking, attending a lesson, or otherwise using the Platform as a Learner (or a parent/guardian booking for a Learner under 18), you agree to these Learner Terms.

2. Drivelo's role

Drivelo is a national online marketplace connecting Learners with independent driving Instructors. Unless Drivelo expressly states otherwise, lessons are supplied by independent Instructors and not by Drivelo. Drivelo facilitates booking, payment, support, communications, reviews and dispute handling.

3. Eligibility and parent/guardian consent

Learners must be at least the minimum age required by the relevant state or territory regulator to hold a learner permit (or to undertake an introductory or pre-permit lesson where lawful). Where the Learner is under 18, the Booking must be made or authorised by a parent or guardian, who agrees to be bound by these Learner Terms on the Learner's behalf.

4. Learner obligations

The Learner must:

  • hold a valid learner permit, licence or other authority required by law for the booked lesson, and present it at the start of the lesson
  • provide accurate booking, contact and payment details
  • ensure suitable footwear and eyewear (where required) for the lesson
  • not attend a lesson under the influence of alcohol, drugs or any substance that may impair driving
  • behave respectfully, lawfully and safely during lessons
  • follow the Instructor's lawful safety directions
  • comply with all road rules of the relevant Australian state or territory.

If the Learner is unfit to drive, the Instructor may refuse or terminate the lesson and the no-show provisions of the Booking, Cancellation and Refund Policy may apply.

5. Booking process

Bookings are subject to Instructor availability, lesson area and confirmation through the Platform. Estimated times, availability and pickup details may change due to traffic, Instructor updates or system issues. The Booking, Cancellation and Refund Policy applies to all changes.

6. Pricing and payment

Lesson pricing is set by the Instructor (in AUD, GST-inclusive where applicable) unless otherwise stated on the Platform. By making a Booking, the Learner (or paying parent/guardian) authorises Drivelo or its payment processor to charge the payment method for lesson fees, processor fees and any other properly disclosed charges under the Payment Policy.

7. Cancellations, rescheduling and refunds

Cancellations, rescheduling, credits and refunds are governed by the Drivelo Booking, Cancellation and Refund Policy, which forms part of these Learner Terms. Nothing limits any rights you have under the Australian Consumer Law.

8. Instructor changes and availability

Drivelo does not guarantee the ongoing availability of any particular Instructor. If your Instructor becomes unavailable, Drivelo will assist with rebooking, credits or refunds in accordance with the Booking, Cancellation and Refund Policy.

9. Safety and conduct

Learners must not:

  • engage in abusive, threatening, discriminatory or unsafe conduct toward Instructors, the public or Drivelo personnel
  • damage the Instructor's vehicle or property
  • record or publish content in a way that breaches privacy or law
  • pressure an Instructor to act unlawfully or unsafely
  • use the Platform or lessons fraudulently
  • engage in any conduct that breaches anti-discrimination, child-safety or road-safety laws.

Drivelo may suspend accounts, cancel Bookings or refuse support where serious misconduct occurs. Safety incidents are managed under the Complaints and Safety Policy.

10. Reviews and content

If you submit a review, rating or other content, you grant Drivelo a non-exclusive, worldwide, royalty-free licence to host, display, use and moderate that content for Platform operation and promotion. You must not submit reviews that are misleading, defamatory or in breach of the ACL.

11. Privacy

Personal information is handled in accordance with the Drivelo Privacy Policy.

12. Liability and Australian Consumer Law

To the maximum extent permitted by law, Drivelo excludes liability for indirect and consequential loss and is not responsible for the independent acts or omissions of Instructors. Nothing in these Learner Terms excludes any non-excludable rights or guarantees under the ACL, including the consumer guarantees that services be provided with due care and skill and be fit for purpose.

13. Account suspension or termination

Drivelo may suspend or terminate a Learner account for fraud, chargeback abuse, safety risk, unlawful conduct, repeated policy breaches or misuse of the Platform.

14. Governing law

These Learner Terms are governed by the laws of Victoria, Australia and the federal laws of the Commonwealth of Australia. Drivelo provides services nationally and nothing in this clause limits any rights you have under the law of another Australian state or territory that cannot be excluded by agreement.
