Instructor Code of Conduct

1. Purpose
This Code of Conduct sets the behavioural and service standards expected of all Instructors using the Drivelo Platform across Australia. It applies in addition to the Instructor Agreement and all Drivelo policies, and to all interactions before, during and after a lesson.
2. Professional conduct
Instructors must:
- treat Learners, parents/guardians, the public and Drivelo personnel with respect and dignity
- communicate professionally, promptly and inclusively
- arrive on time at the agreed pickup point or give reasonable notice if delayed
- deliver lessons in a calm, structured, supportive and safe manner
- use plain English (or the Learner's preferred language where reasonably practicable)
- avoid any conduct likely to damage trust in the Platform or the driving-instruction profession.
3. Safety obligations
Instructors must:
- verify the Learner holds the required permit, licence or authority before the lesson starts
- confirm the Learner is fit to drive (e.g. not affected by alcohol, drugs or fatigue)
- ensure the lesson vehicle is roadworthy, appropriately fitted with dual controls (where required by the relevant state/territory), clean and safe
- comply with all road rules and instructor-licensing obligations of the relevant jurisdiction
- not use a mobile phone unlawfully while instructing
- carry and demonstrate appropriate use of seatbelts, mirrors and dual-control awareness
- stop, refuse or terminate a lesson if safety, weather, road or vehicle conditions require it.
4. Child-safety obligations
Instructors who provide lessons to Learners under 18 must:
- hold and maintain a current Working with Children Check, Blue Card, Ochre Card, Working with Vulnerable People registration or equivalent clearance for each jurisdiction in which they instruct
- support a child-safe environment consistent with the National Principles for Child Safe Organisations
- avoid one-on-one private contact outside the lesson context (text, social media, calls) other than for legitimate booking purposes
- report any reasonable suspicion of child abuse or neglect to the appropriate child-protection authority and notify Drivelo
- not photograph or video a Learner under 18 without the consent of the parent/guardian (and Drivelo where used for marketing).
5. Prohibited conduct
Instructors must not:
- threaten, harass, vilify, humiliate or verbally abuse a Learner, parent, guardian or member of the public
- engage in sexual misconduct, suggestive behaviour, grooming, inappropriate touching or any form of harassment
- discriminate against a Learner on the basis of race, colour, descent, national or ethnic origin, sex, sexual orientation, gender identity, intersex status, disability, age, religion, pregnancy, marital status or any other protected attribute under Commonwealth or state/territory anti-discrimination laws
- consume alcohol, drugs or impairing substances before or during lessons
- accept bribes, undisclosed cash payments or arrangements intended to bypass the Platform
- falsify qualifications, vehicle details, documents, ratings or reviews
- let another person conduct a lesson using the Instructor's account without Drivelo's express written approval
- engage in conduct that breaches Australian law, including the ACL, child-safety, anti-discrimination, road-safety, privacy or workplace-safety laws.
6. Vehicle and presentation standards
Instructors must maintain a professional personal presentation and a clean, well-maintained, roadworthy vehicle suitable for driving instruction, including:
- current registration and CTP/comprehensive insurance
- no smoking or vaping in the vehicle
- operating seatbelts, mirrors, indicators and dual controls (where required)
- clear signage where required by the state/territory regulator.
7. Confidentiality and privacy
Instructors must use Learner personal information only for lesson-related purposes, must not improperly disclose or exploit Learner data, and must comply with the Privacy Act 1988 (Cth), the APPs and the Drivelo Privacy Policy.
8. Marketing and reviews
Instructors must not solicit fake or incentivised reviews, post misleading content, or engage in conduct prohibited by the ACL on misleading or deceptive conduct (including testimonials and pricing claims). Instructors must not contact Learners with marketing communications using Drivelo data except in compliance with the Spam Act 2003 (Cth).
9. Reporting obligations
Instructors must promptly report to Drivelo:
- any safety incident, accident or near-miss
- any complaint, allegation or police contact relevant to instruction
- any licence, accreditation, insurance or vehicle suspension or cancellation
- any change to Working with Children-type clearance status
- any other matter likely to affect Learner safety, regulatory compliance or Drivelo's reputation.
10. Investigations and consequences
Drivelo may investigate complaints and feedback under the Complaints and Safety Policy and may take action including warnings, retraining requirements, profile pause, suspension or termination of the Instructor Agreement. Serious matters may be reported to the relevant regulator, child-protection authority or law enforcement.
